Kuwait’s Ministry of Health has issued a new ministerial decision establishing fees for selected administrative and technical services provided by the Medical Liability Authority, while introducing a specific payment deadline for requests to establish committees reviewing objections to technical reports.
The new requirements will take effect on Sunday, November 1, 2026, under Ministerial Decision No. 351 of 2026, issued by Health Minister Dr Ahmad Abdulwahab Al Awadhi on October 21 and published in the official Kuwait Al Youm Gazette on October 25, 2026.
The decision sets out four categories of services subject to prescribed charges and establishes the financial obligations associated with each type of application.
Under Article One, a fee of KWD 20 will be collected for each administrative service application concerning medical practitioners and healthcare establishments, within the relevant services provided by the Medical Liability Authority.
A separate fee of KWD 20 per application applies to administrative services associated with the Health Licensing Department, as specified under the ministerial decision.
The same KWD 20 fee will also apply to requests for additional copies of technical committee reports issued through the Medical Liability Authority.
The highest fee established under the decision concerns requests for the formation of committees to review objections against technical committee reports. Each such request will be subject to a charge of KWD 200.
This provision is particularly important for parties seeking a formal review of a technical report, as the decision also establishes a strict timeframe for completing the required payment once an objection has been accepted.
Under Article Two, applicants must pay the prescribed committee formation fee within 30 days from the date they are officially notified that their objection has been accepted.
The 30-day period therefore begins when the applicant receives notification of acceptance, rather than automatically beginning on the date the initial objection request was submitted.
The decision explicitly states that if the applicable fee is not paid within the prescribed period, the objection request will be treated as though it had never been submitted.
This condition makes the payment deadline a significant procedural requirement for applicants wishing to proceed with an objection concerning a technical committee report.
Importantly, the KWD 200 charge applies specifically to requests for the formation of objection committees. It should not be interpreted as a general charge imposed on every medical complaint or on all patients receiving treatment in Kuwait.
Similarly, the KWD 20 fees apply to the administrative services and additional report copies identified in the decision. They do not constitute a general increase in hospital treatment costs or medical service charges for all citizens and residents.
The ministerial decision refers to Law No. 70 of 2020 concerning the practice of medicine and allied medical professions, patients’ rights and healthcare establishments as part of its legal framework.
It also cites a Cabinet communication dated October 15, 2026, confirming approval of the proposed service charges, and correspondence from the Medical Liability Authority dated October 19 concerning the deadline for paying objection committee fees.
The measures are intended to establish a clear and consistent schedule of charges for the relevant administrative and technical services, while specifying the payment requirements associated with formal objection procedures.
Article Three confirms that the decision will become effective on November 1, 2026, and that any previous decision or provision conflicting with its requirements will be repealed from the implementation date.
Although the decision has already been issued and officially published, its fee provisions are not yet in force as of October 28, 2026. Applicants should therefore distinguish between the publication date and the date on which the new schedule becomes applicable.
Individuals and organisations seeking services from the Medical Liability Authority are encouraged to verify the applicable service category, review the required documentation and complete any prescribed payments within the official deadlines.
