The incident happened when the Asian taxi driver lost control of his car, drove off the road, and collided with a pavement before running across the manager riding a motorcycle in the Bur Dubai neighborhood. The manager was flung from his motorcycle by the driver's actions, therefore injuring his knees severely.
The manager who was hurt in the accident was taken immediately away to the hospital, where medical tests showed major damage to his right knee including discomfort, swelling, and abrasions above the damaged area. An MRI scan by doctors verified the degree of the injuries: a PCL cortical avulsion fracture and a lateral collateral ligament damage.
After the inquiry, the Dubai Traffic Prosecutors accused the cab driver of several offences including inattentive and careless driving, causing physical harm, and damaging private property. The driver was fined Dh4,000 after entering a guilty plea in court; the Dubai Traffic Court declared him guilty of these offenses.
The manager's attorney, Hani Hammouda Hagag, launched a civil case against the driver in quest of additional recompense for his client's medical, physical, financial, and emotional losses notwithstanding the outcome of the criminal court, The Dh600,000 claim seeks to reimburse the manager's significant expenses including medical bills, pain and suffering that result from the accident.
In the civil lawsuit, the attorney claimed the injury had seriously changed his client's life. The manager has been momentarily hampered by the knee damage, so restricting his capacity for proper walking or working. His doctor has cautioned him against stressing his ailing knee and to use a walking stick. The manager also keeps continuous physiotherapy and treatment; his recovery is far from perfect.
The manager has already paid around Dh200,000 on medical treatments including surgery, drugs, and rehabilitation, according the lawyer's filings to the civil court. The accident has cause him great emotional and physical suffering. Referring to Article 292 of the UAE Civil Transactions Law, which offers compensation in cases of personal injury, the attorney argued that his client is entitled to reimbursement not only for the psychological and emotional toll the injury has taken but also for the treatment-related financial outlay.
With long-term bodily and psychological effects, the manager's lawyer underlined that the accident and consequent injuries severely affected his client's quality of life. Consequently, the Dh600,000 compensation claimed is justifiable as a remedy for the several kinds of damage the manager has endured, both physical and psychic.
Currently under consideration by the pertinent court, the civil case will evaluate the evidence-including medical reports and determine the suitable recompense for the manager's injuries and suffering, The result will decide whether the motorist will be accountable for paying for the requested damages by the injured party.
