Dr. Abduljabbar Al-Tayeb, Chairman of the Board of the Bahraini Jurists Association, affirmed that the recent statement issued by the Public Prosecution falls squarely within its constitutional and legal mandate as a representative of society, not merely as the authority entrusted with initiating and pursuing criminal proceedings, underscoring that its responsibilities extend beyond litigation to safeguarding public order and reinforcing respect for the law.
Al-Tayeb explained that one of the core roles of the Public Prosecution is to raise public awareness regarding the necessity of complying with legal provisions, pointing to the well-established legal principle that ignorance of the law is no excuse, a doctrine that places responsibility on individuals for their conduct and confirms that lack of knowledge does not exempt anyone from accountability.
He noted that publishing any statements or information, whether during wartime or peacetime, if they contain false news or malicious content that could undermine the country’s internal security, weaken economic confidence, or damage the state’s prestige, constitutes a criminal offense punishable under the Bahraini Penal Code by imprisonment, in accordance with applicable legal texts.
Al-Tayeb further stressed that legal compliance in publishing extends beyond written content to include refraining from photographing government facilities or military sites, or circulating any related images or information, warning that such actions may expose perpetrators to criminal liability due to the potential risks posed to national security and public safety.
He clarified that disseminating false news during wartime is considered a serious offense, explaining that if the state formally declares a state of war, the deliberate publication of false information that incites public confusion or harms military preparedness may amount to a felony, carrying penalties that could include imprisonment depending on the gravity and consequences of the act.
The Chairman called on all citizens and residents to exercise caution and prudence when using social media platforms during this period, emphasizing that irresponsible use of such channels can inflict significant harm on society and result in legal consequences.
He concluded by urging full compliance with official directives related to online publishing, avoiding the circulation of unverified information or images, and upholding a strong sense of national responsibility under these circumstances, while praying for the continued safety and protection of Bahrain and its people.
