The Abu Dhabi Court dismissed an employee's AED 200k lawsuit claiming workplace stress led to resignation.
The Abu Dhabi Court of Family and Civil and Administrative Claims has dismissed a lawsuit filed by an employee seeking AED 200,000 in compensation from her former employer. The claimant alleged that she suffered psychological pressure and workplace harassment during her tenure, which prompted her to resign. However, the court noted that it was the plaintiff herself who chose to resign.
In detail, the employee initiated legal proceedings against the company, demanding financial reparation for the physical, psychological, and emotional harm she claimed to have endured due to work-related stress and mistreatment. According to the medical report attached to her case file, these adverse conditions compelled her to resign in order to escape the negative work environment.
The court elaborated that under civil law principles, any harm inflicted upon another obliges the responsible party-whether intentionally or not-to compensate for damages. Nevertheless, documentation revealed that it was indeed the employee’s voluntary decision to resign from her position. The court explained that what she perceived as detrimental actions were simply measures taken by the employer within its discretion to manage its affairs appropriately.
The court further clarified that since it was the employee herself who resigned voluntarily from her job, her demand for both material and moral compensation lacked justification. The absence of conclusive evidence in support of her claim rendered such demands baseless legally and factually.
Consequently, after reviewing all presented documents-including a medical report submitted by the claimant-the court ruled against awarding any compensation due to insufficient proof of entitlement.
