A Dubai court has sentenced a man to three months in prison followed by deportation after he assaulted his wife, leaving her with a permanent disability, The incident which took place on July 1, 2023 resulted in the victim suffering a fractured arm and long-term physical impairment.
Court records state that the Asian-born couple was on Sheikh Zayed Road when an altercation erupted inside their car. Tensions rising, the husband grabbed his wife's left arm, twisted it, then pulled it forcefully behind her back. Her fourth metacarpal bone broke from the forceful action, causing great pain.
The woman escaped the car after the attack and visited Rashid Hospital for medical treatment, In an effort to heal her injuries, medical experts operated on her wounded arm adding a metal plate and screws. The sufferer was left permanently disabled following the operation, medically evaluated at three percent.
The victim formally complained the attack to the Bur Dubai Police on July 5, 2023, She stated in great detail in her complaint how her husband grabbed her arm, twisted it and forcefully placed it behind her during their disagreement, Forensic investigations carried out in October and November later supported her claims by showing that her injuries matched the physical assault she had reported.
The husband acknowledged the attack during police questioning and said his actions had resulted in a lasting damage. He refuted the allegations placed against him, nevertheless, when he showed up for court via video conference. Citing language problems and the lack of a translator during interrogation, his legal agent claimed that his first confession was untrustworthy, Seeking to discredit the prosecution's case, the defense also pointed out differences between the verbal testimony and forensic evidence.
The Dubai Criminal Court decided against the defendant in spite of these defenses, therefore confirming that the evidence unequivocally showed his participation in the attack. His activities resulted in a permanent handicap, according to the judges, thereby violating Article 389 of Federal Decree Law No. 31 of 2021 on Crimes and Punishments. Although the law might have called for a more severe sentence, the court showed clemency under a similar clause, punishing him three months in prison and ordering his deportation when his term came to end.
Though found guilty, the defendant has decided to appeal the decision, therefore contesting the outcome. On January 13, 2025, the Dubai Court of Appeal is scheduled to hear the matter where a last ruling on his punishment and deportation will be decided.
