The Abu Dhabi Global Market (ADGM) has announced updates to its Data Protection Regulations aimed at strengthening public interest rules for handling specific personal data categories. These changes are particularly relevant for sectors like insurance and education.

Abu Dhabi: The Abu Dhabi Global Market (ADGM) Registration Authority has announced amendments to its 2021 Data Protection Regulations, introducing key public interest provisions within the upcoming "2025 Data Protection Regulations." These changes mark a significant step in reinforcing ADGM's dedication to maintaining a comprehensive data protection framework that aligns with global practices and addresses evolving community needs.

The newly established core public interest rules offer crucial insights into processing specific categories of personal data based on defined public interest justifications. These adjustments hold particular significance for sectors such as insurance and education, ensuring compliance with international best practices.

Public Interest Rules

The core aspects covered by these new regulations include:

  • Establishing provisions for insurance companies to process certain categories of personal data for insurance purposes when such processing serves a fundamental public interest.
  • Introducing clear definitions of "insurance contract" and "insurance purpose" to ensure standardized practices across the sector.
  • Providing guidelines that allow for the processing of specific personal data categories without prior consent in scenarios involving the protection of children or individuals at risk of psychological or physical harm.
  • Clarifying criteria under which individuals aged 18 and above can be considered "at risk," thus qualifying them for additional protections under these rules.

Enhanced Protections

This regulatory update is designed to support the expansion of ADGM’s oversight, currently encompassing Al Reem Island, by offering stronger protections for vulnerable groups while facilitating responsible data use in critical sectors.

Building Public Trust

Rashed Al Blooshi, CEO of the ADGM Registration Authority, stated: "Our data protection framework is built on principles of transparency and accountability, aimed at building public trust. The new rules reinforce our commitment to safeguarding individuals, especially those requiring added protection, while enabling responsible data utilization across various industries. We will continue refining our regulatory standards to ensure they meet global benchmarks and local needs."

A Balanced Approach

The amendments represent an important move towards balancing responsible data processing requirements with the necessity of protecting sensitive personal information. By clearly defining circumstances under which special categories of data can be processed, ADGM enhances its ability to protect public interests while supporting vital sectors like insurance and education.
